Terms and Conditions

These Terms & Conditions apply to all commissions, sales of original artwork, prints, and licensing agreements made through Ursus Art (Eva Mout), a sole proprietorship registered in the Netherlands. They are governed by Dutch law. By placing an order, requesting a commission, or making payment, the client accepts these terms.
1. Quotes & Payment
Quotes are valid for 14 days.
Commissions require a non-refundable deposit of 50% before work begins. The remaining balance is due before final, unwatermarked files or the physical artwork are delivered.
Prices exclude shipping, unless stated otherwise.
Payment is due in the currency and by the method stated in the invoice. Chargebacks or payment reversals initiated after work has begun or files have been delivered are treated as a breach of contract, and Ursus Art reserves the right to pursue the outstanding amount and reasonable recovery costs.
Failure to pay the final balance within 30 days of invoicing entitles Ursus Art to withhold delivery indefinitely and retain the deposit.
2. No Right of Withdrawal for Custom Work
Commissioned artwork is made to the client's specifications. Under Dutch and EU consumer law (Art. 6:230p BW), the statutory 14-day right of withdrawal does not apply to custom-made goods. Cancellations after work has started forfeit the deposit; cancellations after completion require payment in full.
3. Copyright & Ownership
Eva Mout retains copyright and moral rights (auteursrecht en persoonlijkheidsrechten) in all artwork at all times, whether original, commissioned, or sold, unless full transfer of economic rights is agreed in writing for an explicitly stated additional fee.
Purchase of a physical original or a print transfers ownership of that object only — never the reproduction rights, unless separately and explicitly agreed in writing.
Commission clients receive a license to use the delivered artwork strictly for the purpose stated in their agreement (e.g. one book cover, one print run, one promotional use). Any use beyond that scope — new editions, merchandise, adaptations, other publications — requires a new written agreement and, ordinarily, an additional fee.
Licensed rights are personal to the client and may not be sublicensed, resold, or transferred to a third party (publisher, printer, platform) without Eva Mout's prior written permission.
4. Prohibited Uses
Without prior written permission, the client may not:
Reproduce, alter, crop, or create derivative works from the artwork beyond the agreed license;
Use the artwork to train, fine-tune, or prompt any AI/machine-learning model;
Mint or sell the artwork, or any derivative, as an NFT or similar digital asset;
Remove or obscure Ursus Art's name/copyright notice where attribution is required under the agreement;
Claim authorship of the artwork.
Any breach entitles Ursus Art to demand immediate cessation, damages, and — where the breach is ongoing or wilful — public correction of attribution.
5. Delivery
Final, delivery-ready files are provided only after full payment has cleared.
6. Client Warranties
If a client supplies reference material, text, characters, or briefs, the client warrants they have the right to use and share that material. The client indemnifies Ursus Art against third-party claims arising from reference material the client provided.
7. Liability
Ursus Art's liability for any claim is limited to the amount paid for the relevant commission or artwork. Ursus Art is not liable for indirect or consequential loss (e.g. lost sales, lost publication deadlines) unless caused by intent or gross negligence.
8. Governing Law & Disputes
These terms and any agreement made under them are governed exclusively by the laws of the Netherlands. Disputes will be submitted to the competent court in the district where Ursus Art is registered, without prejudice to any mandatory consumer-protection rules of the client's own country of residence that cannot be contractually waived.
